Modernization of Migratory Bird Regulation

Modernization of the federal Migratory Birds Regulation was put into force by July 30, 2022. It includes a list of 18 species (Schedule 1), including the Pileated Woodpecker, who continue to have year round nest protection, unless the nests have been shown to be abandoned.

In order to be considered abandoned the Minister must be notified, via an online registration system (the Abandoned Nests Registry), that the nest does not contain a live bird or viable egg, and the nest is to remain unused by migratory birds during the designated wait time for that species.
